Effective date: Upon AfterFlyte public launch
These AfterFlyte Software Terms (“Terms”) govern access to and use of AfterFlyte software, account, activation, billing, update, and support services (collectively, “AfterFlyte”). AfterFlyte is provided by Sporadic Media LLC, doing business as Aero Digital Media (“Aero Digital Media,” “we,” “us,” or “our”).
Beginning on the effective date, by creating an AfterFlyte account, purchasing a subscription, or using AfterFlyte, you agree to these Terms and the AfterFlyte Privacy Policy. If you do not agree, do not use AfterFlyte.
Eligibility and Accounts
AfterFlyte is offered only in the United States to people who are at least 18 years old and able to enter into a binding agreement.
You must provide accurate account information, keep your sign-in credentials secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity performed through your account.
Software License
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use AfterFlyte for your own personal or commercial property-imaging work.
An AfterFlyte Pro subscription is licensed to one named user and permits one registered active desktop device at a time. You may deactivate an old device before activating another. Team licensing is not available in this version. You may not share an account, sell or transfer access, circumvent paid feature controls or device limits, interfere with the service, distribute malware, reverse engineer AfterFlyte except where applicable law expressly permits it, or use AfterFlyte to violate another person’s rights or applicable law.
The license does not transfer ownership of AfterFlyte or its software, branding, documentation, or other intellectual property.
Your Files and Work Product
You retain your rights in the images, project files, annotations, and other content you create or open with AfterFlyte. You are responsible for having the rights and permissions needed to use that content.
AfterFlyte is designed to process image and project content locally on your device. Do not use AfterFlyte to create, store, or distribute unlawful, infringing, harmful, or deceptive material.
AI-Assisted Annotations and Property Information
AfterFlyte can generate AI-assisted annotation drafts. These drafts may be incomplete, inaccurate, or inappropriate for a particular image. You are responsible for reviewing and correcting every result before relying on or exporting it.
AfterFlyte creates visual annotations for property photography workflows. It does not establish legal property boundaries, perform a licensed survey, provide calibrated measurements, or replace advice from a licensed surveyor or other qualified professional. Do not use AfterFlyte output for title, boundary, construction, engineering, safety-critical, or legal determinations.
Starter Allowance and Pro Features
AfterFlyte may provide local editing features, a one-time Starter allowance of 100 finished annotated-image exports per account, and paid AfterFlyte Pro features. Current Pro features include AI Queue drafts, finished annotated-image export, and Batch Save.
Starter requires an AfterFlyte account and online authorization. AI Queue is available while the Starter balance remains, but an allowance is not consumed until export. The first export of a project-image entry consumes one allowance. Re-exporting the same stable project-image entry does not consume another allowance.
A batch is authorized as a whole. If the remaining Starter balance cannot cover every new project-image entry in the batch, the entire batch is rejected and no allowance is deducted.
While usable AfterFlyte Pro access is active, Pro exports bypass the Starter allowance and preserve any existing Starter balance. Pro does not create, reset, or replenish a Starter allowance. When Starter is exhausted, manual editing and existing project files remain unchanged.
We may improve, replace, or discontinue features. We will not use a feature change to avoid obligations that already apply to a paid subscription period.
Subscriptions and Automatic Renewal
AfterFlyte Pro is offered as an automatically renewing subscription:
- Quarterly: $22.22 charged every three months.
- Yearly: $59.99 charged once per year.
Applicable taxes may be added. The price, billing interval, automatic-renewal terms, and cancellation method are shown again before payment.
Unless you cancel before the next renewal charge, your subscription renews for the same billing interval and Stripe charges the payment method associated with your billing account. We will provide at least 30 days’ notice before a subscription price increase applies to a future renewal.
Cancellation and Access
You may cancel online from your AfterFlyte dashboard using the Stripe customer portal. Cancellation is scheduled for the end of the current paid billing period, and no later renewal will be charged.
AfterFlyte Pro online entitlement remains available through the paid-through date. After the paid period, paid features are disabled and the app falls back to any free features then available. An already-issued offline entitlement can remain usable until its encoded expiration and may not reflect a cancellation, device change, or account change until the app reconnects.
Refunds
Your first AfterFlyte Pro purchase is eligible for a refund if you request it within seven calendar days after the charge. Contact support@aerodigital.media from the email address associated with your account.
Renewal charges, partially used billing periods, and requests made after that period are non-refundable except where required by law. We may provide refunds for duplicate charges, billing errors, or exceptional technical failures. Canceling prevents future renewal charges but does not automatically refund the current paid period.
Suspension and Termination
Stripe may retry a failed subscription payment. We do not suspend paid features for a failed renewal until the paid entitlement and any applicable grace period expire.
We may suspend or terminate access when reasonably necessary to address fraud, abuse, security risk, nonpayment, a legal requirement, or a material violation of these Terms. Immediate suspension may be necessary for fraud, abuse, malware, service interference, or security threats. In other cases, when practical, we will provide reasonable notice and an opportunity to correct the issue.
You may stop using AfterFlyte at any time. Ending an account does not create a refund beyond the policy above. Terms that by their nature should continue, including ownership, warranty limitations, liability limitations, and governing law, survive termination.
Updates and Availability
You are responsible for maintaining a compatible device, operating system, network connection when online verification is required, and current software updates. We may require an update to protect security, compatibility, or entitlement integrity.
We provide reasonable-effort support by email but do not offer a service-level agreement. Maintenance, third-party outages, network conditions, incompatible systems, or events outside our reasonable control may interrupt availability.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERFLYTE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that AfterFlyte will be uninterrupted, universally compatible, or error-free, that AI-assisted drafts will be accurate, or that output will satisfy legal, surveying, engineering, regulatory, or customer requirements. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AERO DIGITAL MEDIA AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO AFTERFLYTE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR AFTERFLYTE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply where applicable law does not permit them.
Changes to These Terms
We may update these Terms to reflect changes to AfterFlyte, our business, or legal requirements. We will post and archive dated versions. When practical, we will provide at least 30 days’ notice before a material change takes effect and request renewed consent when legally appropriate.
Governing Law and Disputes
Before filing a claim, you and Aero Digital Media agree to try to resolve the dispute informally for 30 days after written notice. Either party may use an eligible small-claims court without completing that informal period when applicable rules require otherwise.
Florida law governs these Terms, without regard to conflict-of-law principles. Any dispute that is not eligible for small claims must be brought in a court with jurisdiction over Lafayette County, Florida, unless applicable law requires another location.
These Terms do not require mandatory arbitration and do not waive rights that cannot legally be waived.
